1. Acceptance of Terms

Welcome to TenderWatch. These Terms of Service (“Terms”) govern your access to and use of the TenderWatch mobile application, website, and related services (collectively, the “Service”) operated by Deep Forest Lab Pte Ltd (“we”, “our”, or “us”).

By creating an account or using the Service, you agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

TenderWatch is a tender discovery and tracking platform that helps businesses find government tender opportunities. Our Service includes aggregation and display of publicly available tender information, search and filtering tools, bookmark and tracking features, push notifications, AI-powered analysis of tender requirements, and personalised tender recommendations.

3. Account Registration

3.1 Eligibility

To use TenderWatch, you must be at least 18 years of age, have the authority to enter into these Terms (if acting on behalf of a company), provide accurate and complete registration information, and not have been previously banned from using our Service.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

3.3 Account Deletion

You may delete your account and all associated data at any time:

Account deletion requests are processed within 30 days.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not use the Service for any unlawful purpose, attempt to gain unauthorised access, use automated tools without written permission, interfere with the Service, reproduce or resell any part of the Service, send spam, impersonate others, circumvent security measures, or upload harmful code.

4.1 Prohibited Content

Zero Tolerance Policy: The following are strictly prohibited and will result in immediate account termination and reporting to authorities: child sexual abuse material or any form of child exploitation, human trafficking or exploitation, terrorism or violent extremism, and content promoting illegal activities. We actively cooperate with law enforcement agencies.

5. Tender Information

Important Disclaimer: TenderWatch aggregates tender information from publicly available government sources. While we strive for accuracy, we do not guarantee the completeness, accuracy, or timeliness of any tender information displayed.

5.1 Tender information is sourced from official government portals and is provided “as is”. You should always verify tender details, deadlines, and requirements directly with the issuing authority before making any business decisions or submitting any bids.

5.2 Some tender information, including extracted requirements, is processed using artificial intelligence. While we strive for accuracy, AI-generated content may contain errors. Always verify critical information with the original tender documents.

5.3 The Service does not provide legal, financial, or professional advice. Information displayed is for informational purposes only and should not be relied upon as a substitute for professional advice.

6. Subscription and Payment

TenderWatch offers both free and paid subscription tiers. The features available depend on your subscription level. Payment is processed through the App Store (iOS) or Google Play (Android). Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of your current billing period. Refunds are handled according to the respective app store’s refund policies.

7. Intellectual Property

The Service, including its design, features, code, and content (excluding tender data from government sources), is owned by Deep Forest Lab Pte Ltd and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes. Tender information sourced from government portals remains subject to the terms of those original sources. If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information in compliance with the Singapore Personal Data Protection Act 2012 (PDPA). By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.

We do not warrant that the Service will be uninterrupted, error-free, or secure; that any tender information will be accurate, complete, current, or reliable; that the Service will meet your specific requirements; that defects will be corrected; or that AI-generated analysis will be free from errors.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SINGAPORE LAW, DEEP FOREST LAB PTE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL ARISING FROM your use or inability to use the Service, reliance on tender information, missed deadlines or unsuccessful submissions, errors in AI-generated content, unauthorised access to your account, or any interruption of the Service.

Our total liability for any claims under these Terms shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) SGD 100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Deep Forest Lab Pte Ltd, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or your violation of any applicable laws.

12. Termination

You may terminate your account at any time by deleting it through app settings, the account deletion page, or by contacting us. We may suspend or terminate your access immediately if you breach these Terms, if required by law, if we discontinue the Service, or if we reasonably believe your conduct may harm us or others. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnification, and dispute resolution) will survive termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with an updated date, sending a notification through the app, and requiring you to accept the new Terms before continuing to use the Service. Your continued use after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

Informal Resolution: Contact us at legal@deepforestlab.com. We will attempt to resolve disputes informally within 30 days.
Mediation: If informal resolution fails, disputes may be submitted to mediation under the Singapore Mediation Centre.
Courts: Either party may pursue claims in the courts of Singapore, which shall have exclusive jurisdiction.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deep Forest Lab Pte Ltd regarding the Service.
Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control.
